Common use of GIFTS TO PUBLIC SERVANTS Clause in Contracts

GIFTS TO PUBLIC SERVANTS. (a) The Owner may terminate this Contract immediately if the Prime Contractor has offered, conferred, or agreed to confer any benefit on a City of Xxxxxx employee or official that the City of Xxxxxx employee or official is prohibited by law from accepting. (b) For purposes of this Article, "benefit" means anything reasonably regarded as pecuniary gain or pecuniary advantage, including benefit to any other person in whose welfare the beneficiary has a direct or substantial interest, but does not include a contribution or expenditure made and reported in accordance with law.
