Common use of Government Access to Records Clause in Contracts

Government Access to Records. Business Associate agrees to make available its policies, books and records related to the use and disclosure of PHI received or created by Business Associate on behalf of the Covered Entity to the Secretary of the U.S. Department of Health and Human Services or his or her designee for the purpose of determining whether Business Associate and/or Covered Entity is in compliance with HIPAA requirements.

Government Access to Records. Business Associate agrees to will make available its policiesinternal practices, books and records related relating to the use and disclosure of PHI received from or created or received by Business Associate on behalf of the of, Covered Entity available to the Secretary for purposes of the U.S. Department of Health and Human Services or his or her designee for the purpose of Secretary determining whether Business Associate and/or Covered Entity is in Entity’s compliance with HIPAA requirementsthe Privacy Rule and the Security Rule.

Government Access to Records. Business Associate agrees to shall make available its policiesinternal practices, books books, and records related relating to the use and disclosure of PHI received from, or created or received by Business Associate on behalf of the Covered Entity of, Client available to the Secretary of the U.S. Department of Health and Human Services or his or her designee (the “Secretary”) for the purpose purposes of determining whether Client’s and Business Associate’s compliance with HIPAA. Business Associate and/or Covered Entity is shall notify Client in compliance with HIPAA requirementswriting of any such audit by the Secretary.
