Because all Parties are governmental entities under the Utah Governmental Immunity Act of Utah, Utah Code § 63G-7-101, et. seq., as amended (the “Act”), each Party is responsible and liable for any wrongful acts or negligence committed by its own officers, employees, or agents and no Party waives any defense available to it under the Act.
