Common use of Grant of Sublicense Clause in Contracts

Grant of Sublicense. Subject to the terms and conditions of this Agreement, BFA hereby grants to the Companies a sublicense to use the Indexes (and associated data, information, and Marks) listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement including, without limitation, the restriction in paragraph 2.5 of the License Agreement that the Companies will not have the further power to sublicense third parties to use the Indexes and Marks.

Grant of Sublicense. Subject to the terms and conditions of this Agreement, BFA hereby grants to the Companies a sublicense sublicenses to use the MSCI Indexes (and associated data, data and information, ) and Marks) the MSCI Marks listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement includingAgreement, including without limitation, limitation the restriction in paragraph 2.5 Section 1(b) of the License Agreement that the Companies will not have the further power to sublicense third parties to use the MSCI Indexes and the MSCI Marks.

Subject to the terms and conditions of this Agreement, BFA hereby grants to the Companies a sublicense to use the Indexes (and associated data, information, and Marks) listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement including, without limitation, the restriction in paragraph 2.5 3 of the License Agreement that the Companies will not have the further power to sublicense third parties to use the Indexes and Marks.

Subject to the terms and conditions of this Agreement, BFA hereby grants to the Companies a sublicense to use the Indexes (and associated data, information, and Marks) listed on Exhibit A in the manner set forth in, and subject to the terms of, Section 9 of the License Agreement includingAgreement, including without limitation, limitation the restriction in paragraph 2.5 Section 9 of the License Agreement that the Companies will not have the further power to sublicense third parties to use the Indexes and Marks, absent written consent of NASDAQ.

Grant of Sublicense. Subject to the terms and conditions of this Agreement, BFA hereby grants to the Companies a sublicense to use the Dow Xxxxx Indexes (and associated data, information, information and Dow Xxxxx Marks) listed on Exhibit A in the manner set forth in, and subject to the terms of, the License Agreement includingAgreement, including without limitation, limitation the restriction in paragraph 2.5 3 of the License Agreement that the Companies will not have the further power to sublicense third parties to use the Dow Xxxxx Indexes and the Dow Xxxxx Marks.
