Common use of Grant to Introgen Clause in Contracts

Grant to Introgen. Subject to the terms and conditions of this Agreement, RPRP hereby grants to Introgen the following licenses and sublicenses, as the case may be, under the RPRP Technology: (i) to use and sell the Collaboration Products in the Field in the Co-Exclusive Territory; (ii) to make and have made the Collaboration Products anywhere in the world for use and sale in the Field solely within North America and the Co-Exclusive Territory. The licenses under (i) above shall be royalty-free and co-exclusive (with RPRP), and the license under (ii) above shall be royalty-free (except as provided in Article 9) and non-exclusive.
