Gross Negligence and Willful Misconduct. Notwithstanding anything to the contrary set forth herein, the limitations provided in Section 9.1 and Section 9.2 shall not apply in case of gross negligence (faute lourde), willful misconduct (faute intentionnelle) or fraud.
