However, because the statutory maximum is 15 years, the effective guidelines range would be 180 months’ imprisonment. The parties agree that if the adjusted offense level for Count 3 is 21 and the defendant’s criminal history category is II, then the guidelines range for Count 3 is 41-51 months’ imprisonment.
