Common use of HANDLING, LOADING AND SEALING Clause in Contracts

HANDLING, LOADING AND SEALING. (a) CARRIER will comply with handling instructions provided by the shipper, consignor or consignee (including such instructions that may be passed through to CARRIER by BROKER) including, but not limited to, compliance with requirements related to transportation of temperature controlled shipments and the safe handling of food. If such instructions include refrigeration, CARRIER must verify that the trailer is pre-cooled at the time of loading and that temperatures are maintained within the required temperature ranges as specified in the Xxxx of Lading at all times during transit as evidenced by a function temperature recording device inside the trailer. The driver must ensure that temperature recorder is placed inside, halfway back and up high on the trailer sidewall. Refrigerated trailers must be equipped with a chute throughout the trailer and for shipments containing produce, refrigerated equipment must be set to run continuously. Carrier is responsible to ensure vents and chutes are unobstructed. Chute MUST be intact with no rips, punctures or tears. If instructions provided to CARRIER require a cargo seal, the lack of a seal upon delivery shall be sufficient to consider the shipment unsafe and a total loss. CARRIER must provide temperature data in accordance with instructions provided to CARRIER upon request. If goods tendered include produce, CARRIER must always set the refrigeration unit to run continuous.
