Hat Creek 2002 Federal Energy Regulatory Commission License for the Hat Creek Project. On November 4, 2002, the Federal Energy Regulatory Commission (FERC) issued a new license for the Hat Creek Project. As stipulated in the new license, minimum instream flows in the Hat 1 Bypass Reach were increased from 2 cfs to 8 cfs. In addition, the flow release at the Xxxx Lake Dam (a minimum of 8 cfs) and accretion flow from the Hat 2 Springs must provide a minimum flow in the lower portion of the Hat 2 Bypass Reach of 43 cfs (measured at the Xxxxxxx Diversion Dam).
