Common use of Hazardous Substance Clause in Contracts

Hazardous Substance. Hazardous Substance" shall mean any chemical, substance, material, or waste, including without limitation asbestos, PCBs and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactive, or by other similar term, by any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effect.

Hazardous Substance. a substance that is defined under an Environmental Law as hazardous waste, Hazardous Substance" shall mean any chemical, substance, hazardous material, or waste, including without limitation asbestos, PCBs and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactivepollutant, contaminant, petroleum, petroleum product, or by other similar term, by any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effectoil.

Hazardous Substance. “Hazardous Substance" ” shall mean and refer to any chemical, hazardous or toxic substance, material, material or waste, including without limitation asbestosincluding, PCBs but not limited to, those substances, materials, and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactive, wastes listed in the United States Department of Transportation Hazardous Materials Table (49 C.F.R. 172.101) or by the United States Environmental Agency as hazardous substances (40 C.F.R. Part 302 and amendments thereto), petroleum products and their derivatives, and such other similar termsubstances, materials and wastes as are or become regulated or subject to cleanup authority by any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effectjurisdiction under any Environmental Laws.

Hazardous Substance" shall mean means any chemicalpetroleum or petroleum-related product, substanceany materials containing friable asbestos or any other hazardous or toxic waste or substance (as such terms are used in applicable federal and/or state Laws regulating the generation, materialstorage, transportation, discharge, disposal, release or waste, including without limitation asbestos, PCBs and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactive, or by other similar term, by any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effectremoval of environmentally hazardous substances).

Hazardous Substance. Hazardous Substance" shall mean Substance means any chemicalsubstance that is regulated by any local government, substancethe State of Colorado, materialthe United States government, or any agency, authority and/or instrumentality thereof and includes any and all materials or substances that are defined as "hazardous waste", including without limitation "extremely hazardous waste", or a "hazardous substance" pursuant to any Environmental Law. Hazardous Substance includes but is not restricted to petroleum and petroleum byproducts, asbestos, PCBs explosives, polychlorinated biphenyls ("PCBs") and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactive, or by other similar term, by any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effectinfectious waste.

Hazardous Substance. The term “Hazardous Substance" shall mean Substances” means any waste, chemical, material or substance that is listed or regulated, whether presently or in the future, under Environmental Laws as a “hazardous” or “toxic” substance, material, material or waste, or as a “contaminant,” or is otherwise listed or regulated under Environmental Laws (irrespective of whether it is listed as a “hazardous” or “toxic” substance, material or waste or as a “contaminant”), including without limitation asbestos, PCBs Solid Waste and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactive, or by other similar term, by any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effectmunicipal wastes.

Hazardous Substance. “Hazardous Substance" shall mean ” means any chemicalsubstance defined as “waste”, “hazardous waste”, “hazardous substance”, “hazardous material”, “toxic substance”, “pollutant”, “contaminant” in, or waste, including without limitation asbestos, PCBs and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactive, or by other similar term, by which are otherwise specifically subject to regulation under any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effectEnvironmental Law.
