Headings; Interpretation; Construction. The headings used in this Agreement are for convenience only and are not part of this Agreement. In the event that Medicis makes a claim for damages based on rescission or breach of this Agreement, nothing in this Agreement shall be construed as precluding Medicis from seeking recovery of those amounts paid by Medicis under this Agreement to the extent such amounts are recoverable under applicable law and Impax’s liability is not limited by Section 9.4.
