Common use of Headroom Clause in Contracts

Headroom. Con Xxxxxx may interconnect other developers' projects to the Substation, notwithstanding Generator's payment of Substation Modification Costs. Such interconnection by another developer(s) shall not reduce Generator’s payment obligation under this Agreement. However, to the extent that Generator’s payments for System Upgrade Facilities and Substation Modifications under this Agreement qualify as having created “Headroom” under Attachment S to the ISO OATT, Generator (not Con Edison) shall be entitled to the benefits associated with such Headroom under the ISO OATT.
