Common use of Healthcare Entity Mitigation Clause in Contracts

Healthcare Entity Mitigation. In addition, Healthcare Entity agrees to mitigate, to the extent practicable, any harmful effect that is known to Healthcare Entity of a use or disclosure of PHI by Healthcare Entity in violation of the requirements of this Agreement, and report its mitigation activity back to the Department. Healthcare Entity shall preserve documentation and other evidence related to the event and any mitigation for a minimum of 7 years from the date of the final closure of the incident.
