Hearing Office Appointment and Duties. Upon receipt of a request for a hearing from an affected faculty member, the President shall notify the College and request that the College appoint an impartial hearing officer. The hearing officer shall be an attorney in good standing with the Washington State Bar Association and shall not be an employee of the State of Washington or any of its political subdivisions, with the exception of an Administrative Law Judge. The hearing officer shall also not be a member of the Board of Trustees of any community college in the State of Washington. 1. In the case of a reduction-in-force for reasons set forth in Section 1, C, at the time of a faculty member’s request for formal hearing, the faculty member may ask to participate in choosing the hearing officer in the manner provided in RCW 28A.405.310(4): a. When there is more than one (1) faculty member affected by the College’s reduction-in- force, faculty members requesting hearing must act collectively in making such request; b. Costs incurred for the services and expenses of the hearing officer shall be shared equally by the College and the faculty member requesting a hearing.
