HEARINGS OR MEETINGS. Hearings or meetings shall be conducted at a time and place which will afford a fair and reasonable opportunity for all persons. Hearings or meetings shall be conducted during non- school hours, unless there is mutual agreement for other arrangements. At the request of the grievant, the Association shall have the right to have a representative of the Association present at such hearings or meetings. Time limits herein may be extended only by mutual agreement signed by both parties. A. If there is a failure at any step to communicate the decision on a grievance or to meet with the grievant within the specified time limit, the grievant shall then have the right to appeal at the next step of the procedure. B. Any grievance not advanced from one step to the next within the specified time limits, shall be deemed resolved by the answer at the previous step. C. Copies of all documents, communications, and records dealing with the processing of a grievance shall be made available to the Association at the request of the grievant. D. All documents, communications, and records dealing with the processing of a grievance shall be filed separately from the personnel files of the participants and are not valid basis for evaluations. E. Any grievance which arose prior to the effective date of this Agreement or after the termination date of this Agreement shall not be processed. F. The term “working days” as referred to in the procedure shall mean Monday through Friday with the exception of legal holidays, and/or school vacation days as set forth by the school calendar.
