HOLD HARMLESS INDEMNIFICATION AND ATTORNEY FEES. A. The Design Professional shall indemnify and hold the City and its agents, employees, and officers, harmless from any and all liability for damages, including claims, demands, suits, at law or equity, actions, penalties, losses, damages, or costs, of whatsoever kind or nature, brought against the City arising out of, in connection with, or incident to (1) the Design Professional’s breach of contract, negligence, recklessness, or intentional misconduct; or
