Common use of ICN Retained Rights Clause in Contracts

ICN Retained Rights. During the License Period, ICN retains all rights to the Product in the Territory that are not explicitly granted to Schering under this Agreement. Without in any way limiting the foregoing, ICN retains, both during and after the License Period, all rights in the Territory for products owned or controlled by it other than the Product, including, without limitation, the right to distribute, market and sell any such other product in the Territory (e.g. lyophilized ribavirin, or cream, ointment or liquid ribavirin). Except for such retained rights or as expressly provided elsewhere in this Agreement, nothing in this Section 2.3 shall be deemed to compromise or limit the exclusive license granted to Schering under Section 2.1.
