Common use of Illegality and Severability Clause in Contracts

Illegality and Severability. If a court of competent jurisdiction holds any provision of this Agreement to be invalid, illegal or unenforceable (whether in whole or in part), such provision shall be deemed modified or not to form part of this Agreement to the extent, but only to the extent, of such invalidity, illegality or unenforceability and the remaining provisions of this Agreement shall remain valid and not be affected thereby.
