Common use of Immediate Effect Clause in Contracts

Immediate Effect. ‌ 16.8.1 Notwithstanding other provisions of this Article, an employee against whom disciplinary action is to be taken may be immediately suspended upon verbal notification pending a hearing when the District determines that his/her presence would be detrimental to the welfare of the District, the public, or other employees of the District. 16.8.2 This verbal notification shall be followed by service upon the employee of the written notice as set forth in 16.4.2. Failure of the District to provide the required written notice within five (5) calendar days shall render the verbal notice a nullity.
