Implementation in UK. 185) In the UK, the domestic legislation implementing the EIA Directive is split into 1) central legislation for ‘nationally significant infrastructure projects,’ that require development consent under the Planning Act 2008;785 and relevant to unconventional gas exploration and development, and 2) territorial legislation for those projects requiring planning permission under the town and country planning legislation for each of England,786 Wales,787 Scotland788 and Northern Ireland.789 In both cases, the regulations recently adopted in 2017 reflect the changes made to EU Directive 2011/92/EU1 (“the EIA Directive”) by EU Directive 2014/52/EU.
