Common use of Improvements; Prosecution by Licensee Clause in Contracts

Improvements; Prosecution by Licensee. Notwithstanding the provisions in Section 3.6 above, if Licensor fails to file an application for patent or other protection therefor within six (6) months after receipt of a written request from Licensee to do so, Licensor shall be deemed to have consented to Licensee obtaining and maintaining the necessary protection therefor at Licensee's expense.
