Common use of In case Clause in Contracts

In case. (a) the Company shall declare a dividend (or any other distribution) on its Common Stock that would require an adjustment in the Conversion Price pursuant to Section 4.05; or

In case. (ai) the Company shall declare a dividend (or any other distribution) on its Common Stock that would require cause an adjustment in to the Conversion Price of the Series 5.375% Debentures pursuant to the terms of any of the subparagraphs above (including such an adjustment that would occur but for the terms of the first sentence of Section 4.055.03(a)(viii) above); or
