In-Service Date. The date upon which the Interconnection Customer reasonably expects it will be ready to begin use of the Distribution Provider’s Interconnection Facilities to obtain back feed power.
In-Service Date. The date on which the Unit was first purchased by the original owner, if known. Units for which the original purchase date is not known, it shall be July 1st of the Unit model year.
In-Service Date. The earliest date on which the EV Charging Equipment is installed and operational.
In-Service Date. A date after the Activation Date when the NEON fibers are transmitting light from a revenue producing customer including, without limitation, NU.
In-Service Date. A condition or event of Force Majeure affecting the achievement of the In-Service Date shall not relieve Seller from Termination Damages for early termination under Section 16.1(Termination Due to Failure to Meet the Guaranteed In-Service Date), although such a condition or event of Force Majeure shall, if and for so long as the conditions of Section 21.3 (Satisfaction of Certain Conditions) are satisfied, have the effect of deferring such liabilities to the extent of the grace period provided in Section 13.3(B).
In-Service Date. Not withstanding any other provision of this Article 15 (Events of Default) to the contrary, any failure of Seller to achieve the In-Service Date by the Guaranteed In-Service Date shall be governed by Article 13 (Construction Milestones Including the Guaranteed In-Service Date) in lieu of this Article 15 (Events of Default).
In-Service Date. Seller shall provide to PSNH, subject to PSNH approval, a plan for testing and startup of the Facility at least thirty (30) days prior to the dates upon which Seller tests the Facility in order to establish the In-Service Date. PSNH shall have the right to be present at the Site during start-up and testing (subject to all safety procedures in effect at the Site), and/or to receive documentary evidence of the Facility’s operation.
In-Service Date. The date of initial interconnection of the Generation Facility to LADWP’s electric system.
In-Service Date. (a) Unless otherwise approved in writing by the LDC, the Participant will cause the Project or Portfolio, as the case may be, to achieve the requirements necessary to meet the In-Service Date on or before the earlier of: (i) the second anniversary of the date hereof and (ii) December 31, 2020 [NTD: In-Service Date to be updated as per project timelines].
(b) The Participant will deliver to the LDC not less than 10 Business Days’ prior written notice of the date of the commissioning of the Project or Portfolio, as the case may be, and of the proposed In-Service Date and will provide any data in electronic or written form relating thereto as may be reasonably requested by the LDC or the Technical Reviewer.
(c) The process to confirm if a Project or Portfolio has achieved the requirements to meet the In-Service Date and that the In-Service Date has occurred is as set out in the M&V Plan and may involve one of the following options: (i) on-site review by the Technical Reviewer; (ii) on-site review by the LDC; or (iii) written confirmation by a registered professional engineer licensed to practice in Ontario.
(d) Upon confirmation of the occurrence of the In-Service Date as per Section 6.2(c) above, the LDC will notify the Participant of such confirmation.
In-Service Date. (a) Pursuant to the terms of the Terminal Precedent Agreement and following the satisfaction or waiver of the conditions precedent set forth therein, Operator will issue the In-Service Date Notice (as defined in the Terminal Precedent Agreement).
(b) Operator will be obligated to provide the LTD Expansion Service and Customer will be obligated to pay for the LTD Expansion Service commencing on the In-Service Date in accordance with this Agreement.
