Common use of Inability by VicForests to Provide Access Clause in Contracts

Inability by VicForests to Provide Access. (a) If VicForests is unable to provide the Contractor with access to Harvest Sites scheduled in the Monthly Plan, VicForests shall estimate the quantity of Timber it has not made available to the Contractor or that the Contractor has not been able to harvest based on the Annual Plan (Shortfall) and if reasonably practicable add that Shortfall to subsequent Monthly Quantities.
