Inadvertent Failures to Designate. If timely corrected, an inadvertent 23 failure to designate qualified information or items does not, standing alone, waive 1 the designating party’s right to secure protection under this agreement for such 2 material. Upon timely correction of a designation, the receiving party must make 3 reasonable efforts to ensure that the material is treated in accordance with the 4 provisions of this agreement.
