Common use of Inapplicability Clause in Contracts

Inapplicability. Notwithstanding the other provisions of this article, this waiver of liability shall not be applicable to: Claims between a Consortium Member and its related entities; Claims made by a natural person, his/her estate, survivors, or subrogates for injury or death of such natural person; Claims for damage caused by willful misconduct; or Intellectual property claims.
