Inclusion of Documents Clause Samples

Inclusion of Documents. Consultant’s response submitted in response thereto, including any best and final offer, are incorporated in this Agreement by reference and form an integral part of this agreement. In the event of a conflict in language between this Agreement and the foregoing documents incorporated herein, the provisions and requirements set forth in this Agreement shall govern. In the event of a conflict between the language of the RFP, as amended, and the Consultant’s submittal, the language in the former shall govern. This Agreement may be executed in any number of counterparts, each of which shall be an original, but all of which together shall constitute one and the same instrument.

Inclusion of Documents. Except for this Agreement, there are no other documents included by reference as part of this Agreement.

Inclusion of Documents. The Statement of Work, the RFP (including any documents referenced therein) and Contractor's Proposal submitted in response thereto are incorporated into this Contract by reference and form an integral part of this Contract. The contractual relationship between Contractor and BOR shall be governed by the following order of precedence: (i) the provisions of this Contract, including all exhibits attached hereto and incorporated into this Agreement; (ii) the Statement of Work; (iii) the RFP (excluding any sample agreements attached to such RFP); and (iv) Contractor’s Proposal (excluding any sample agreements attached to such Proposal). No objection or amendment by Contractor to the RFP requirements or to the sample agreement attached to such RFP shall be incorporated by reference in this Agreement unless BOR has accepted such objection or amendment in writing. Any pre-printed contract terms and conditions included on Contractor’s forms or invoices shall be null and void.

Inclusion of Documents. This RFP, all addenda, and the submittal in response to this RFP will be required to be incorporated as part of any final Contract. Invoices are to be sent to the individual department contact and will be processed upon receipt for payment.

Inclusion of Documents. The RFP, all addenda and the Proposal submitted in response to the RFP shall be become a part of any contract awarded as a result of the RFP.

Inclusion of Documents. RFQ PWUP 23-12, any amendments thereto, and the Contractor’s submittal in response thereto, including any best and final offer, are incorporated in this Agreement by reference and form an integral part of this agreement. In the event of a conflict between the language of the RFP and the Contractor's Proposal, the language in the RFP shall govern. In the event of a conflict between the language of this Service Agreement and any other document or instrument incorporated herein, the language of this Service Agreement shall govern.

Inclusion of Documents. The RFP, the Proposal submitted in response to this RFP and any written correspondence submitted prior to negotiation of the final contract will be required to be incorporated as part of the final Contract. Payment terms (Prompt Pay Discounts), if offered, must be prominently noted on all invoices. Any cash discount included in the offer will form a part of the related contract. State cash discount offered, if any: Days, Net Days.

Inclusion of Documents. The following documents are incorporated as though contained in the body of this Agreement:
