Incorporation ofRecitals. The foregoing recitals are hereby incorporated into and made a part of this Agreement as if fully set forth in this first paragraph. 0 a: 0 2. Waiver. Declarant will not modify or amend the Easement without the consent of Parcel C Owner, its successors and assigns, which consent shall not be unreasonably withheld, delayed or conditioned, and hereby waives any right Declarant may have to do otherwise pursuant to the Easement.
