Incorrect Device Clause Samples

The "Incorrect Device" clause defines the procedures and responsibilities when a device provided or used under an agreement is found to be incorrect or not as specified. Typically, this clause outlines the steps the supplier or user must take to rectify the situation, such as replacing the device, providing a suitable alternative, or compensating the affected party. Its core practical function is to ensure that any errors in device provision are promptly addressed, thereby maintaining the integrity of the agreement and minimizing disruption or risk to the parties involved.
Incorrect Device. If the Device you return pursuant to a Swap does not correspond to the Registered Device (model & IMEI), then you must return the correct Registered Device (at your own cost) within 7 days of receipt of a notice from Samsung to do so. If you fail to do so, Samsung will charge you a Device Non-Return Fee. The notice from Samsung will specify the amount of the applicable Device Non-Return Fee. You authorise Samsung to charge your Credit Card for the Device Non-Return Fee. You may request Samsung to return the incorrect Device to you at your cost.
Incorrect Device. If the Device you return pursuant to a Swap or Good Working Order Value Trade-In does not correspond to the Registered Device (by model & IMEI) (Incorrect Device), then you must return the correct Registered Device (at your own cost) within seven (7) days of receipt of a notice from Samsung to do so. If you fail to do so, you will be charged a Device Non-Return Fee. You will be advised of the amount of the applicable Device Non-Return Fee. You authorise Asurion to charge your Credit Card for the Device Non-Return Fee. You may request for the Incorrect Device to be returned to you at your cost. You authorise Asurion to charge your Credit Card for the additional delivery fees.
Incorrect Device. If you make a Service Request for a Swap but the Device claimed to be the Registered Device is not the Registered Device, your Service Request may be rejected or you may be required to pay the Replacement Fee instead of the Swap Fee.
Incorrect Device. In the case of a Swap (i) if the make, model or IMEI of the Device you present does not correspond to that of the Registered Device, then the Service Request will not be completed; or (ii) if True discovers that the Device you returned via the Courier was not the Registered Device at the time the Service Request was completed, then you must return the correct Registered Device within 7 days of the Delivery Time at your own cost and if you fail to do so True may treat the Swap as a Replacement and charge you the Additional Fee.
