Increases in Security on Second Security Delivery Date. If on the second Security Delivery Date during the Land Acquisition and Construction Phase, the Independent Engineer’s Report reflects that the Additional Cost Exposure exceeds the amount of Security then in place, then the Turnkey Contractor shall increase the Security to an amount equal to the lesser of (i) the Additional Cost Exposure as so determined and (ii) the difference between (a) the Adjusted Required Security, and (b) the aggregate amount of Security drawn under Section 10.4.4.
