In consideration of my use of the Climbing Wall, I agree to release and on behalf of myself, my heirs, representatives, executors, administrators, and assigns, HEREBY DO RELEASE The St. Cloud Area Family YMCA (“YMCA”), its officers, agents, and employees from any cause of action, claim, or demand of any nature whatsoever, including but not limited to, a claim of NEGLIGENCE, which I, my heirs, representatives, executors, administrators and assigns may now have, or have in the future against the YMCA on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to my use of the Climbing Wall whether that use is supervised or unsupervised, however the injury or damage is caused, including, but not limited to the NEGLIGENCE of the YMCA, its officers, agents, and employees. In consideration of my use of the Climbing Wall, I, the undersigned user, agree to INDEMNIFY AND HOLD HARMLESS the YMCA, its officers, agents, and employees from any and all causes of action, claims, demands, losses, or costs of any nature whatever arising out of or in any way related to my use of the Climbing Wall. I hereby certify that I have full knowledge of the nature and extent of the risks inherent in the use of the Climbing Wall and that I am voluntarily assuming the risks. I understand that I will be solely responsible for any loss or damage, including death, I sustain while using the Climbing Wall and that by this agreement the YMCA is released of any and all liability for such loss, damage, or death. I further certify that I am in good health and that I have no physical limitations which would preclude my safe use of the Climbing Wall. I further certify that I am of lawful age (18 years or older) and otherwise legally competent to sign this agreement. I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement, after have carefully read it, of my own free will. I accept full responsibility for my own safety and the safety of other climbers while in the climbing gym area. I agree to abide by, and to help enforce, the following climbing wall safety policies:

In consideration of my use of the Climbing Wall, I, the undersigned user, agree to INDEMNIFY AND HOLD HARMLESS the YMCA, its officers, agents, and employees University from any and all causes of action, claims, demands, losses, losses or costs damages of any nature whatever whatsoever arising out of or in any way related relating to my use of the Climbing WallWalls, and covenant not to sue for any such causes of action, claims, demands, losses or damages other than those claims arising solely from gross negligence of Cornell University, its officers, trustees, or employees. I hereby certify that I have full knowledge of the nature and extent of the risks inherent in the use of the Climbing Wall and that I am voluntarily assuming the these risks. I understand that I will be solely responsible for any loss or damage, including death, I sustain while using the Climbing Wall and that by this agreement agreement, I am relieving the YMCA is released of any and all liability for such loss, damage, disability, or death; and that I will waive my right to sue the YMCA on any grounds expressly or implicitly covered by this release. In consideration of my use of the Climbing WallRopes Course, I, the undersigned user, agree to INDEMNIFY IDEMNIFY AND HOLD HARMLESS the Silver Bay YMCA, its officers, agents, agents and employees from any and all causes of action, claims, claims demands, losses, or costs of any nature whatever arising out of or in any way related relating to my use of the Climbing WallRopes Course. I hereby certify that I have a full knowledge of the nature and extent of the risks inherent in the use of the Climbing Wall Ropes Course and that I am voluntarily assuming the risks. I understand that I will be solely responsible for any loss or damage, including death, I sustain while using the Climbing Wall Ropes Course and that by this agreement the Agreement, I am relieving Silver Bay YMCA is released of any any, and all liability for such loss, damage, or death. I further certify that I am in good health and that I have no physical limitations limitations, which would preclude my safe use of the Climbing Wall. I further certify that I am of lawful age (18 years or older) and otherwise legally competent to sign this agreement. I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement, after have carefully read it, of my own free will. In consideration of my use of the Climbing The Rock Wall, I agree to release the undersigned user and on behalf of myself, my heirs, representatives, executors, administrators, and assigns, HEREBY DO RELEASE The St. Cloud the Waynesboro Area Family YMCA (“YMCA”), its officers, agentsstaff, and employees employees, or agents from any cause causes of action, claimclaims, or demand demands of any nature whatsoever, including but not limited to, to a claim of NEGLIGENCE, which I, my heirs, representatives, executors, administrators administrators, and assigns may now have, have or have in the future against the Waynesboro Area YMCA on account of resulting from personal injury, property damage, death or accident of any kind, arising out of or in any way related to my use of The ROCK, regardless of how the Climbing Wall injury or damage is caused or whether that such use is supervised or unsupervised, however the injury or damage is caused, including, but not limited to the NEGLIGENCE of the YMCA, its officers, agents, and employees. In consideration of my use of the Climbing Rock Wall, I, the undersigned user, agree to INDEMNIFY AND HOLD HARMLESS the Waynesboro Area YMCA, its officers, agentsstaff, employees, and employees agents from any and all causes of action, claims, demands, losses, or costs of any nature whatever whatsoever arising out of or in any way related relating to my use of the Climbing The Rock Wall. I hereby certify that I have full knowledge of the nature and extent of the risks inherent in with the use of the Climbing The Rock Wall and that I am voluntarily assuming the these risks. ; I understand that I will be solely responsible for any loss or damagedamage I sustain, including death, related to my use of The Rock Wall. By this agreement, I sustain while using am relieving the Climbing Wall and that by this agreement the Waynesboro Area YMCA is released of any and all liability for such loss, damage, or death. I further hereby certify that I am in good health and that I have no physical limitations which would preclude my safe use of the Climbing The Rock Wall. I understand that I will be solely responsible for any loss or damage, including death, that I sustain while using the Climbing Wall Walls and that by this agreement I am relieving the YMCA is released University of any and all liability for such loss, damage, or death. I certify that I meet the affiliation requirements for use of the Climbing Walls. I further certify that I am in good health and that I have no physical limitations which that would preclude my safe use of the Climbing WallWalls. In consideration of my use of the Climbing Wallchallenge course, I, the undersigned user, agree to INDEMNIFY AND HOLD HARMLESS the YMCASouthern District YMCA / Camp Lincoln, its officers, agents, and employees from any and all causes of action, claims, demands, losses, or costs of any nature whatever arising out of or in any way related to my use of the Climbing Wallchallenge course. In addition, I release and discharge The Company and all of the other releasees from all actions, claims, or demands that I and my heirs, distributes, guardians, legal representatives, or assigns now or in the future may have for any injury, death, or property damage resulting from my use or the use by my Son/Daughter/Xxxx’x use of the Climbing Wall conducted by The Company. I agree for myself and my heirs, distributes, guardians, legal representatives, and assigns that in the event that any claim for personal injury, death or property damage shall be prosecuted against The Company, and/or any or all of the other releasees, I shall indemnify and save harmless The Company and/or all of the other releasees from any and all such claims or causes of action, claims, demands, losses, or costs of any nature whatever arising out of or in any way related to my use of the Climbing Wallaction by whomever made and wherever presented. I hereby certify that I have full knowledge of the nature and extent of the risks inherent in the use of the Climbing Wall and that I am voluntarily assuming assume the risks.
