Indemnification for the Cost Consequences of Current Tax Liability Imposed Upon the Transmission Provider. Notwithstanding Article 5.17.1, Interconnection Customer shall protect, indemnify and hold harmless Transmission Provider from the cost consequences of any tax liability imposed against Transmission Provider as the result of payments, property transfers or use of Transmission Provider’s Interconnection Facilities, Transmission System (including any Network Upgrades to that Transmission System) and/or Distribution System (including any Distribution Upgrades to that Distribution System) by Interconnection Customer under this GIA, as well as any interest and penalties, other than interest and penalties attributable to any delay caused solely by Transmission Provider.
