Indenture Trustee or the Collateral Agent May File Proofs of Claim. In case of the pendency of any receivership, insolvency, liquidation, bankruptcy, reorganization, arrangement, adjustment, composition or other judicial proceeding relative to the Issuing Entity or any other obligor upon the Notes or the property of the Issuing Entity or of such other obligor or their creditors, the Indenture Trustee (irrespective of whether the principal of the Notes will then be due and payable as therein expressed or by declaration or otherwise and irrespective of whether the Collateral Agent will have made any demand on the Issuing Entity for the payment of overdue principal or interest) will be entitled and empowered either directly or through instruction to the Collateral Agent to do the same by intervention in such proceedings or otherwise:
