Common use of INDEPENDENT OPTION CONSIDERATION Clause in Contracts

INDEPENDENT OPTION CONSIDERATION. In consideration of and concurrently with Owner entering into this Agreement, Optionee agrees to pay to Owner the sum of One Thousand Dollars ($1,000) as “independent option consideration” (the “Option Consideration”). The Option Consideration has been bargained for and agreed to as separate and independent consideration for Optionee’s option to lease the Property pursuant to the terms herein, and for Owner’s execution and delivery of this Agreement. The Option Consideration shall be deemed fully earned by Owner upon receipt, and shall be considered non-refundable to Optionee except as otherwise provided in Section 9.1 below.
