Independent payment obligations. The Borrower and/or the Assignor expressly agrees that each of its obligations to pay or repay under this Assignment or the Security Documents – (a) constitute separate and independent obligations; (b) give rise to separate and independent causes of action; (c) apply regardless of any waiver or indulgence given by the Bank for any other obligation; (d) remain in full force and effect regardless of any judgment, order, claim or proof for a liquidated amount in respect of any other obligation; and (e) can be relied upon and enforced by the Bank independently or, or together with, any other action under such obligations or under the Security Documents, and the Bank does not need to first use any other remedy available to the Bank.
