Common use of Independent Settlement Clause in Contracts

Independent Settlement. This Settlement of the Action is not conditioned on the 4 disposition of the claims of the direct purchaser plaintiffs, the direct purchaser class or the non- 5 class direct purchaser plaintiffs, all of whom filed their own complaints. This Settlement 6 Agreement is not conditioned on the performance or disposition of any other settlement 7 agreement between the End-Payor Class and any other Defendant.
