Common use of Individual Data Clause in Contracts

Individual Data. In respect of any data or information (including, without limitation, data covered by banking secrecy and/or personal data laws) regarding an individual (including, without limitation, any employees of the Company or its Affiliates) (“Individual Data”) provided to any Finance Party, the Company represents and warrants that it has obtained each relevant individual’s prior consent to the collection, use, disclosure and processing of his/her Individual Data by the Finance Parties, and that such Individual Data is true, accurate and complete in all material respects.
