Individual determinations. (i) The head of the contracting activity may make a determination that an article, material, or supply is not mined, pro- duced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality. (ii) If the contracting officer con- xxxxxx that the nonavailability of an article is likely to affect future acqui- sitions, the contracting officer may submit a copy of the determination and supporting documentation to the ap- propriate council identified in 1.201–1, in accordance with agency procedures, for possible addition to the list in 25.104.

Individual determinations. If the offer of an end product from a qualifying country source listed in 225.872–1(b), as evaluated, is low or otherwise eligible for award, prepare a determination and findings exempting the acquisition from the Buy American Act and the Balance of Payments Program as inconsistent with the public interest, unless another exception such as the Trade Agreements Act applies. Follow the procedures at PGI 225.872– 4.

Individual determinations. For students with disabilities the District believes may not be eligible for the vocational education and/or driver’s education program, the District will make an individual determination of the student’s eligibility based upon the essential requirements developed in #2 above. The determination will be made by a group of individuals knowledgeable about the student, the evaluation data, and the essential requirements of each program, and in compliance with the provisions of Section 504 at 34 C.F.R. §§104.34, 104.35, and 104.36. Documentation of the determination will be maintained in the student’s cumulative file. The District will develop appropriate procedures to implement this provision, including the identification of staff that will make these determinations and the timeframes for when the determinations will be made.

  • Expert Determination If a Dispute relates to any aspect of the technology underlying the provision of the Goods and/or Services or otherwise relates to a financial technical or other aspect of a technical nature (as the Parties may agree) and the Dispute has not been resolved by discussion or mediation, then either Party may request (which request will not be unreasonably withheld or delayed) by written notice to the other that the Dispute is referred to an Expert for determination. The Expert shall be appointed by agreement in writing between the Parties, but in the event of a failure to agree within ten (10) Working Days, or if the person appointed is unable or unwilling to act, the Expert shall be appointed on the instructions of the relevant professional body. The Expert shall act on the following basis: he/she shall act as an expert and not as an arbitrator and shall act fairly and impartially; the Expert's determination shall (in the absence of a material failure to follow the agreed procedures) be final and binding on the Parties; the Expert shall decide the procedure to be followed in the determination and shall be requested to make his/her determination within thirty (30) Working Days of his appointment or as soon as reasonably practicable thereafter and the Parties shall assist and provide the documentation that the Expert requires for the purpose of the determination; any amount payable by one Party to another as a result of the Expert's determination shall be due and payable within twenty (20) Working Days of the Expert's determination being notified to the Parties; the process shall be conducted in private and shall be confidential; and the Expert shall determine how and by whom the costs of the determination, including his/her fees and expenses, are to be paid.
