Ineligible for Compensation Sample Clauses

Ineligible for Compensation. The Customer is not eligible for compensation under paragraph 7.3 if: (a) OptiComm is not in a position to avoid an event or occurrence which caused the non- compliance with the Service Level due to acts or omissions of a third party, the Customer, the End-user or a Force Majeure event;
Ineligible for Compensation. The Customer is not eligible for compensation under paragraph 24.4(s) if: (i) CommSol Holdings is not in a position to avoid an event or occurrence which caused the non-compliance with the Service Level due to acts or omissions of a third party, the Customer, the End-user or a Force Majeure event; (ii) the Customer has been notified by CommSol Holdings of a planned outage which, in CommSol Holdings sole opinion, is required to maintain the Network at an optimum operating performance; (iii) the End-user has not cooperated with CommSol Holdings or its agents and denied access to the Customer’s premises; or (iv) delays are due to the need for CommSol Holdings to comply with the Law.
