Common use of INFORMATION OF BUYER Clause in Contracts

INFORMATION OF BUYER. Information provided by Buyer to Seller remains the property of Buyer. Seller agrees to keep confidential and otherwise protect from disclosure all information obtained by Seller from Buyer in connection with this Subcontract and identified by Buyer as confidential or proprietary including, but not limited to, equipment, tools, gauges, patterns, designs, drawings, engineering data, and computer programs and software, as well as information subject to a non-disclosure agreement between the Parties. Unless otherwise expressly authorized by Buyer, Seller shall use such information, and any other information provided by Buyer to Seller, only in the performance and for the purposes of this Subcontract. Seller shall maintain data protection processes and systems sufficient to adequately protect Buyer’s information, including but not limited to encryption if transmitted via the Internet or during electronic storage if potentially accessible by the Internet or otherwise by non‐authorized users, and shall comply with any law or regulation applicable to such information.
