Common use of Initial Purchasers' Information Clause in Contracts

Initial Purchasers' Information. The Company, the Co-Issuer and the Initial Purchasers severally acknowledge that the statements with respect to the delivery of the Original Notes to the Initial Purchasers set forth in the first sentence of the fourth paragraph, the first sentence of the sixth paragraph, the seventh paragraph and the eight paragraph under the caption "Plan of distribution" in the Preliminary Offering Memorandum and the Offering Memorandum constitute the only information furnished in writing by any Initial Purchaser expressly for use in the Preliminary Offering Memorandum or the Offering Memorandum.

Initial Purchasers' Information. The Company, the Co-Issuer Company and the Initial Purchasers severally Guarantor acknowledge that the statements with respect to the delivery offering of the Original Initial Notes to the Initial Purchasers set forth in the first third sentence of the fourth second paragraph, the first sentence of the sixth paragraph, the seventh fourth paragraph and the eight fifth sentence of the eighth paragraph under the caption "“Plan of distribution" Distribution” in the Preliminary Offering Memorandum and the Offering Memorandum constitute the only information relating to the Initial Purchasers furnished to the Company and the Guarantor in writing by any or on behalf of the Initial Purchaser Purchasers expressly for use in the Preliminary Offering Memorandum or the Offering Memorandum.

The Company, the Co-Issuer Company and the Initial Purchasers severally acknowledge and agree that the statements with respect only information relating to any Initial Purchaser that has been furnished to the delivery of Company in writing by any Initial Purchaser through the Original Notes to the Initial Purchasers set forth in the first sentence of the fourth paragraph, the first sentence of the sixth paragraph, the seventh paragraph and the eight paragraph under the caption "Plan of distribution" Representatives expressly for use in the Preliminary Offering Memorandum and the Offering Memorandum constitute (or any amendment or supplement thereto) consists of the only information furnished in writing by any following: the statements concerning the Initial Purchaser expressly for use Purchasers contained in the Preliminary Offering Memorandum or third paragraph, fifth and sixth sentences of the Offering Memorandumninth paragraph and the eleventh paragraph under the heading "Plan of Distribution."
