Common use of Initial Purchasers' Information Clause in Contracts

Initial Purchasers' Information. The Company acknowledges that the statements with respect to the offering of the Series C Notes set forth in the last paragraph of the cover page and the first sentence of the third paragraph and the fourth sentence of the fifth paragraph under the caption "Plan of Distribution" in such Offering Memorandum constitute the only information furnished in writing by the Initial Purchaser expressly for use in the Offering Memorandum.
