INSOLVENCY OF ELIGIBLE FOREIGN CUSTODIANS. The Custodian shall not be responsible or liable for any losses or damages suffered by the Funds arising as a result of the insolvency of any Foreign Custodian except with respect to any Foreign Custodian in any Selected Country which the Custodian appointed in accordance with the provisions of Article II but only to the extent that the Custodian failed to comply with the standard of care set forth in Article II with respect to the selection and monitoring of such Foreign Custodian.
