Installation Timetable. The works specification submitted by the Contractor to the Customer shall include and specify the date(s) for:
(a) completion of the design of the EPC Solutions;
(b) commencement of the installation of the EPC Solutions;
(c) progress claims to be made by the Contractor during the installation period, subject to achievement of the benchmarks to be identified in the works specification; and
(d) completion of the installation and commissioning of the EPC Solutions (“contractual completion date”) which must be consistent with any corresponding dates identified in the DFS unless the Customer agrees otherwise.
Installation Timetable. The Works Specification submitted by the ESCO to the Agency must include and specify the date(s) for: the completion of the design of the EPC Solutions; the commencement of the installation of the EPC Solutions; progress claims to be made by the ESCO during the Installation Period, subject to achievement of the benchmarks to be identified in the Works Specification; completion of the installation of the EPC Solutions; and must be consistent with any corresponding dates identified in the DFS unless the Agency agree otherwise. The ESCO must complete the installation of the EPC Solutions on or before the Contractual Completion Date unless agreed otherwise. On receipt of the Agency's instructions under Clause 2.2 or approval under Clause 3., the ESCO must install the EPC Solutions or any additional EPC Solutions at the Premises in accordance with the Works Specification by the Contract Completion Date. During the installation period, the ESCO must: give the Agency reasonable prior notice of its requirements for access and storage; meet regularly with the Agency to provide progress reports on the installation procedure and keep the Agency informed of all matters it ought reasonably to be made aware of; not cause or permit any act which may unreasonably interfere with the use of the Premises or the Core Business of the Agency; provide qualified Personnel, supervision, tools and materials, Equipment and plant to install the EPC Solutions at the Premises; use suitable new materials which are fit for purpose in the installation of the EPC Solutions where the nature of the materials to be used is not specified in the Works Specification; ensure that the EPC Solutions works are at all times adequately protected and kept secure until the Completion Date; not allow for the delivery of any plant, material or other things before reasonably required in connection with the EPC Solution Works by the ESCO, its employees, agents or contractors; ensure that utility services to or from the Premises are not disconnected or disrupted at any time without the Agency's prior consent and are promptly reinstated; and ensure that all necessary remedial action required by the Agency is taken to rectify any damage done to any of the Agency's Premises (including chattels) by the ESCO's Personnel in the performance of the EPC Solutions works.
