Common use of Installment Payment Cap Clause in Contracts

Notwithstanding anything to the contrary in this Section 4, in no event whatsoever shall the aggregate amount of the Installment Payments and the Installment Payment Premiums paid to the Shareholders from PainCare in cash, in PainCare Shares or any other form of consideration, valued as provided in this Agreement, exceed Four Million Two Hundred Fifty Thousand and 00/100 Dollars ($4,250,000).
