Common use of INSTITUTION OF PROCEEDINGS; INJUNCTION Clause in Contracts

INSTITUTION OF PROCEEDINGS; INJUNCTION. There shall not have been instituted by any Person (including any Governmental Authority) any Proceeding to restrain or invalidate the transactions contemplated by this Agreement or the Services Agreement, and there shall not be in effect any injunction or restraining order issued by a court of competent jurisdiction in a Proceeding against the consummation of the transactions contemplated by this Agreement or the Services Agreement.
