Common use of Institution's Financial Condition Clause in Contracts

Institution's Financial Condition. Institution represents and warrants that it shall deliver to Federated its audited annual report, its quarterly financial reports and such other financial statements as Federated shall reasonably request which indicate the Institution's financial condition and, if applicable, net capital ratio. Institution further represents and warrants that such statements fairly represent its financial condition and/or net capital ratio on the date of such statements and that there has been no material adverse change in its financial condition and/or net capital ratio since that date.
