Common use of Instructions to the Trustee Clause in Contracts

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A or such other designees as the Grantor may designate by amendment to Exhibit A. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s orders, requests, and instructions. All orders, requests, and instructions by the FDEP Secretary to the Trustee shall be in writing, signed by the FDEP Secretary, or the designee, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEP, except as provided herein.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A or such other designees persons as the Grantor may designate by amendment to Exhibit A. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP IDNR hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEP, IDNR except as provided for herein.

Instructions to the Trustee. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPAgency, except as provided for herein.

The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPTCEQ, except as provided for herein.

The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP State Water Control Board hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPState Water Control Board, except as provided for herein.

The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP NDEQ hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEP, NDEQ except as provided for herein.

Xxxxxx or such other designees as the Grantor may designate by amendment to Exhibit A. this Agreement. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s 's orders, requests, and instructions. All orders, requests, and instructions by the FDEP Secretary District to the Trustee shall be in writing, signed by the FDEP SecretaryDeputy Executive Director of Resource Regulation, or the Deputy Executive Director’s designee, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP District hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPDistrict, except as provided for herein.

The Grantor shall notify the Corps of any disbursements made from the trust within ten (10) days after the disbursement.

The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPState Water Control Board, except as provided for herein.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A a Managing Partner of EIP Credit Co, LLC or such other designees as the Grantor may designate by amendment to Exhibit A. this Agreement. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s 's orders, requests, and instructions. All orders, requests, and instructions by the FDEP Secretary District to the Trustee shall be in writing, signed by the FDEP SecretaryRegulation Director, or the Regulation Director's designee, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP District hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPDistrict, except as provided for herein. The Grantor shall notify the Corps of any disbursements made from the trust within ten (10) days after the disbursement.

The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPEPD, except as provided for herein.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A Managing Partner of EIP Credit Co., LLC or such other designees as the Grantor may designate by amendment to Exhibit A. this Agreement. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s 's orders, requests, and instructions. All orders, requests, and instructions by the FDEP Secretary District to the Trustee shall be in writing, signed by the FDEP SecretaryRegulation Director, or the Regulation Director's designee, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP District hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPDistrict, except as provided for herein. The Grantor shall notify the Corps of any disbursements made from the trust within ten (10) days after the disbursement.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A or such other designees as the Grantor may designate by amendment amendments to Exhibit A. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s 's orders, requests, and instructions. All orders, requests, and instructions by the FDEP Secretary EPD Director to the Trustee shall be in writing, signed by the FDEP Secretary, EPD Director or the his designee, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP EPD hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPEPD, except as provided for herein.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A or such other designees as the Grantor may designate by amendment to Exhibit A. All orders, requests, and instructions by the FDEP Secretary TCEQ executive director to the Trustee shall be in writing, signed by the FDEP Secretary, executive director or the executive director=s designee, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP TCEQ hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPTCEQ, except as provided for herein.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A signatories to this agreement or such other designees as the Grantor may designate by amendment to Exhibit A. in writing. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s 's orders, requests, and instructionsinstruction. All If the North Carolina Department of Environment and Natural Resources, Radiation Protection Section issues orders, requests, and or instructions by the FDEP Secretary to the Trustee these shall be in writing, signed by the FDEP Secretary, agency or the designeeits designees, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP hereunder agency, hereunder, has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPagency, except as provided for herein.

All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A signatories to this agreement or such other designees as the Grantor may designate by amendment to Exhibit A. in writing. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s 's orders, requests, and instructions. All If the NRC or State agency issues orders, requests, and or instructions by the FDEP Secretary to the Trustee Trustee, these shall be in writing, signed by the FDEP SecretaryNRC, or the designeeState agency, or their designees, and the the- Trustee shall act and shall be fully protected in acting actirig in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the ' authority of any person to act on behalf of the Grantor Grantor, the NRC, or the FDEP State agency, hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, , . - . .- . - .. . . - . . . and instructions instruction from the Grantor and/or the FDEPNRC, or State agency, except as provided for herein.

Instructions to the Trustee. All orders, requests, and instructions by the FDEP Secretary COMMISSIONER to the Trustee shall be in writing, signed by the FDEP SecretaryCOMMISSIONER, or the designeeOR THE COMMISSIONER’S DESIGNEE, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP DEEP hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPDEEP, except as provided for herein.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A Schedule B or such other designees as the Grantor may designate by amendment to Exhibit A. Schedule B. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s 's orders, requests, and instructions. All orders, requests, and instructions by the FDEP Secretary GAEPD Director or designee to the Trustee shall be in writing, signed by the FDEP Secretary, GAEPD Director or the designee, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP GAEPD Director or designee hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPGAEPD Director or designee, except as provided for herein.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A Appendix B or such other designees others as the Grantor may designate be designated by amendment to Exhibit A. Appendix B. The Trustee shall be fully protected in acting without inquiry in accordance with the Grantor’s 's orders, requests, and instructions where Grantor is authorized under this Agreement to issue such orders, requests and instructions. All orders, requests, requests and instructions by the FDEP Secretary DES to the Trustee shall be in writing, signed by the FDEP Secretary, or the designee, and the Commissioner. The Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP hereunder DES has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, requests and instructions from the Grantor and/or the FDEPDES, except as provided for herein. In the event that the Trustee receives contradicting instructions from the Grantor and the Commissioner, or in the event of a dispute between the Grantor and the Commissioner, the Trustee shall be entitled to rely and act upon the instructions of the Commissioner without incurring any liability and obligation with respect to the Grantor.

All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A or such other designees as the Grantor may designate by amendment to Exhibit A. All orders, requests, and instructions by the FDEP Secretary DEQ Director to the Trustee shall be in writing, signed by the FDEP Secretary, DEQ Director or the his or her designee, and the Trustee shall act and shall be fully protected in acting in accordance with such orders, requests, and instructions. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP DEQ hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPDEQ, except as provided for herein.

Instructions to the Trustee. All orders, requests, and instructions by the Grantor to the Trustee shall be in writing, signed by such persons as are designated in the attached Exhibit A or such other designees as the Grantor may designate by amendment to Exhibit A. The Trustee shall have the right to assume, in the absence of written notice to the contrary, that no event constituting a change or a termination of the authority of any person to act on behalf of the Grantor or the FDEP DEEP hereunder has occurred. The Trustee shall have no duty to act in the absence of such orders, requests, and instructions from the Grantor and/or the FDEPand /or DEEP, except as provided for herein.
