INSURED EQUIPMENT. Insured Equipment means the mechanical, electronic, or rental equipment specified in the Schedule/Certificate, but not including any motor vehicles. For the purpose of this Policy, such Insured Equipment may be either (i) owned, (ii) sold, (iii) serviced under a contract, (iv) taken on rent, or (v) given on rent by the Insured.

INSURED EQUIPMENT. Insured Equipment shall mean any equipment owned, leased, operated or controlled by you as described below: A. any boiler, fired or unfired pressure vessel normally subject to vacuum or internal pressure other than static pressure of contents, any refrigerating or air conditioning vessels and piping or any other piping and its accessory equipment, any heat exchanger that forms part of a forced air heating equipment, but not including: (i) any boiler setting, any refractory or insulating material; (ii) any part of a boiler or fired pressure vessel that does not contain steam or water; nor (iii) any buried piping or vessel, any drainage piping, any sprinkler piping and its accessory equipment; B. any mechanical or electrical equipment used for the generation, transmission or utilization of mechanical or electrical power, but not including: (i) any conveyor, crane, elevator or hoist, but not excluding any electrical equipment used with any such apparatus; (ii) any Vehicles or Insured Equipment mounted on a Vehicle, but not excluding Insured Equipment that is; a. mounted on wheels or a trailer in order to make it transportable; b. not used to drive or steer such wheels or trailer; and c. stationary and in use at the location specified in the Declarations at the time of the Breakdown or Electronic Circuitry Impairment; C. any electronic equipment, device or instrument or fibre optic cable used for research, diagnosis, treatment, communication, word processing, data processing, duplicating, scanning or monitoring.

INSURED EQUIPMENT. Insured Equipment shall mean any equipment owned, leased, operated or controlled by the Insured as described below: (a) any boiler, fired or unfired pressure vessel normally subject to vacuum or internal pressure other than static pressure of contents, any refrigerating or air conditioning vessels and piping or any other piping and its accessory equipment, any heat exchanger that forms part of forced air heating equipment, any jacketed milk vessel, but not including: (i) any boiler setting, any refractory or insulating material; (ii) any part of a boiler or fired pressure vessel that does not contain steam or water; nor (iii) any buried piping, any drainage piping, any sprinkler piping and its accessory equipment; (b) any mechanical or electrical equipment used for the generation, transmission or utilization of mechanical or electrical power, but not including: (i) any Vehicle or Insured Equipment mounted on a Vehicle, but not excluding Insured Equipment that is: (1) mounted on wheels or a trailer in order to make it transportable; (2) not used to drive or steer such wheels or trailer; and (3) stationary and in use at the Location specified in the Declarations at the time of the Breakdown or Electronic Circuitry Impairment; (ii) any irrigation system, but not excluding: (1) any central pivot; (2) any tower control box; (3) any wheel; (4) any drive mechanism for any swing arm or corner attachment and any equipment forming a part of the driving or controlling mechanism used therewith; nor (5) any sensor, control or pump and any equipment forming a part of the driving or controlling mechanism used therewith; (iii) any lifting or safety cables, anchorages, car buffers or counterweight buffers forming part of an elevator system; (iv) any conveyor belt; nor (v) any Farm Implement; (c) any electronic equipment, device, instrument or fibre optic cable used for, communication, word processing, data processing, duplicating, monitoring or scanning but not including any Farm Implement External Electronics; (d) any Vehicle-Mounted GPS including any steering assemblies, servo-motors, mixing, metering or hydraulic assemblies directly controlled by such Vehicle-Mounted GPS or any controller computer.

  • Stored equipment We accept no responsibility for any stored equipment or other property brought on to or left at the premises, and all liability for loss or damage is hereby excluded. All equipment and other property (other than stored equipment) must be removed at the end of each hiring or we will charge fees each day or part of a day at the hire fee per hiring until the same is removed. We may, in our discretion, dispose of any items referred to below by sale or otherwise on such terms and conditions as we think fit, and charge you any costs we incur in storing and selling or otherwise disposing of the same, in any of the following circumstances: (i) your failure either to pay any charges in respect of stored equipment due and payable or to remove the same within seven days after the agreed storage period has ended (ii) your failure to dispose of any property brought on to the premises for the purposes of the hiring.

  • Leased Equipment The risk of loss or damage to leased equipment, goods or property shall not transfer to the University except as provided in §680.219, Florida Statutes. Any security interest in the leased equipment, goods or property granted to the Contractor contrary to AGO 79-72 and AGO 80-9 is null and void. Limitations of remedies provisions, which are unconscionable under applicable Florida law, are void. MATERIAL SAFETY DATA SHEET (MSDS). In compliance with Florida Statutes, Ch. 442, a Material Safety Data Sheet (MSDS) must accompany any applicable item delivered under this Agreement.

  • Required Equipment Employees are expected to be at their individual work stations with required equipment in operable condition at the scheduled shift starting time.

  • Supplies and Equipment The Union and employees will not use state-purchased supplies or equipment to conduct union business or representational activities. This does not preclude the use of the telephone for representational activities if there is no cost to the Employer, the call is brief in duration and it does not disrupt or distract from the Employer’s business.

  • Office Equipment The Client must not install any cabling, IT or telecom connections without the Provider’s consent, which the Provider may refuse at its absolute discretion.

  • Fixtures and Equipment Each of the Company and its Subsidiaries (as applicable) has good title to, or a valid leasehold interest in, the tangible personal property, equipment, improvements, fixtures, and other personal property and appurtenances that are used by the Company or its Subsidiary in connection with the conduct of its business (the “Fixtures and Equipment”). The Fixtures and Equipment are structurally sound, are in good operating condition and repair, are adequate for the uses to which they are being put, are not in need of maintenance or repairs except for ordinary, routine maintenance and repairs and are sufficient for the conduct of the Company’s and/or its Subsidiaries’ businesses (as applicable) in the manner as conducted prior to the Closing. Each of the Company and its Subsidiaries owns all of its Fixtures and Equipment free and clear of all Liens except for (a) liens for current taxes not yet due and (b) zoning laws and other land use restrictions that do not impair the present or anticipated use of the property subject thereto.

  • Facilities and Equipment Except as set forth herein, Consultant shall, at its sole cost and expense, provide all facilities and equipment that may be necessary to perform the services required by this Agreement. City shall make available to Consultant only the facilities and equipment listed in this section, and only under the terms and conditions set forth herein. City shall furnish physical facilities such as desks, filing cabinets, and conference space, as may be reasonably necessary for Consultant’s use while consulting with City employees and reviewing records and the information in possession of the City. The location, quantity, and time of furnishing those facilities shall be in the sole discretion of City. In no event shall City be obligated to furnish any facility that may involve incurring any direct expense, including but not limited to computer, long-distance telephone or other communication charges, vehicles, and reproduction facilities.

  • Furniture, Fixtures and Equipment Sublessee shall have the right to use during the Term the office furnishings and equipment within the Subleased Premises that are identified on Exhibit C attached hereto, as such exhibit may be adjusted by mutual agreement of the parties prior to the Third Floor Premises Delivery Date (the “Furniture”), provided Sublessee may only use the Furniture located in the Second Floor Premises after the Second Floor Commencement Date. The Furniture is provided in its “AS IS, WHERE IS” condition, without representation or warranty whatsoever. Sublessee shall insure the Furniture under the property insurance policy required under the Master Lease, as incorporated herein, and pay all taxes with respect to the Furniture. Sublessee shall maintain the Furniture in good condition and repair, reasonable wear and tear excepted, and shall be responsible for any loss or damage to the same occurring during the Term. Sublessee shall surrender the Furniture to Sublessor upon the termination of this Sublease in the same condition as exists as of the applicable Delivery Date, reasonable wear and tear excepted. Sublessee shall not remove any of the Furniture from the Subleased Premises. Notwithstanding anything to the contrary herein, Sublessee may provide Sublessor with written notice one (1) time not less than forty-five (45) days prior to the Third Floor Premises Delivery Date that lists any items of Furniture that Sublessee does not want to use and Sublessor shall, at no cost to Sublessee, remove such items from the Subleased Premises prior to the Third Floor Premises Delivery Date and such items shall no longer be considered Furniture hereunder. Notwithstanding the foregoing, provided Sublessee is not in default beyond the expiration of any applicable cure or grace period as of the date of the expiration or earlier termination of this Sublease, which condition may be waived by Sublessor in its sole discretion, then upon the expiration or earlier termination of this Sublease, the Furniture shall become the property of Sublessee, and Sublessee shall accept the same in its “AS IS, WHERE IS” condition, without representation or warranty whatsoever except as provided in the Bill of Sale referred to in the following sentence. In the event the Furniture is to become the property of Sublessee upon the expiration or earlier termination of this Sublease pursuant to the terms of the immediately preceding sentence, then Sublessor agrees to execute and deliver to Sublessee a Bill of Sale in the form of Exhibit D attached hereto conveying and transferring to Sublessee the Furniture.

  • Care of Equipment Equipment can only be used in a careful and proper manner and shall not be used in any way that is inconsistent with Owner’s instructions or manuals.

  • Property and Equipment The buildings, plants, structures located at the Plant Property and the Equipment are all owned by the CCC Company free and clear of all Liens (except Permitted Liens) and are structurally sound, are in good operating condition and repair, subject to normal wear and tear, and are adequate for the uses to which they are being put, and none of such buildings, plants, structures, personal property or Equipment is in need of maintenance or repairs except for ordinary, routine maintenance and repairs that are not material in nature or cost.
