Common use of Interest Rate Limitation Clause in Contracts

Interest Rate Limitation. Notwithstanding anything herein to the contrary, if at any time the applicable interest rate, together with all fees and charges that are treated as interest under applicable law (collectively, the “Charges”), as provided for herein or in any other document executed in connection herewith, or otherwise contracted for, charged, received, taken or reserved by any Lender or any Issuing Bank, shall exceed the maximum lawful rate (the “Maximum Rate”) that may be contracted for, charged, taken, received or reserved by such Lender in accordance with applicable law, the rate of interest payable hereunder, together with all Charges payable to such Lender or such Issuing Bank, shall be limited to the Maximum Rate; provided, that such excess amount shall be paid to such Lender or such Issuing Bank on subsequent payment dates to the extent not exceeding the legal limitation.

Notwithstanding anything herein to the contrary, if at any time the applicable interest rate, together with all fees and charges that are treated as interest under applicable law (collectively, the “Charges”), as provided for herein or in any other document executed in connection herewith, or otherwise contracted for, charged, receivedtaken, taken received or reserved by any Lender or any Issuing Bank, shall exceed the maximum lawful rate (the “Maximum Rate”) that may be contracted for, charged, taken, received or reserved by such Lender -Lender in accordance with applicable lawlaw (the “Maximum Lawful Rate”), then so long as the Maximum Lawful Rate would be so exceeded, the rate of interest payable hereunderand all such charges payable, together with all Charges payable contracted for, charged, taken, received or reserved in respect of the Loan of the Lender to such Lender or such Issuing Bank, the Borrowers shall be limited equal to the Maximum Lawful Rate; provided, that such excess amount shall be paid to such Lender or such Issuing Bank on subsequent payment dates to the extent not exceeding the legal limitation.

Interest Rate Limitation. Notwithstanding anything herein to the contrary, if at any time the applicable interest rate, together with all fees and charges that which are treated as interest under applicable law (collectively, collectively the “Charges”), as provided for herein or in any other document executed in connection herewith, or otherwise contracted for, charged, received, . taken or reserved by any Lender or any Issuing BankLetter of Credit Issuer, shall exceed the maximum lawful rate (the “Maximum Rate”) that may be contracted for, charged, taken, received or reserved by such Lender in accordance with applicable law, the rate of interest payable hereunder, together with all Charges payable to such Lender or such Issuing Bankthe Letter of Credit Issuer, shall be limited to the Maximum Rate; provided, provided that such excess amount shall be paid to such Lender or such Issuing Bank the Letter of Credit Issuer on subsequent payment dates to the extent not exceeding the legal limitation.

Interest Rate Limitation. Notwithstanding anything herein or in the Notes to the contrary, if at any time the applicable interest rate, together with all fees and charges that which are treated as interest under applicable law (collectively, collectively the “"Charges”"), as provided for herein or in any other document executed in connection herewith, or otherwise contracted for, charged, received, taken or reserved by any Lender or any Issuing BankLender, shall exceed the maximum lawful rate (the “"Maximum Rate”") that which may be contracted for, charged, taken, received or reserved by such Lender in accordance with applicable law, the rate of interest payable hereunderunder the Note held by such Lender, together with all Charges payable to such Lender or such Issuing BankLender, shall be limited to the Maximum Rate; provided, provided that such excess amount shall be paid to such Lender or such Issuing Bank on the subsequent payment dates to the extent not exceeding the legal limitation.

Interest Rate Limitation. Notwithstanding anything herein or in the Notes to the contrary, if at any time the applicable interest rate, together with all fees and charges that which are treated as interest under applicable law (collectively, the “"Charges”"), as provided for herein or in any other document executed in connection herewith, or otherwise contracted for, charged, received, taken or reserved by any Lender or any Issuing BankLender, shall exceed the maximum lawful rate (the “"Maximum Rate”") that which may be contracted for, charged, taken, received or reserved by such Lender in accordance with applicable law, the rate of interest payable hereunderunder the Note held by such Lender, together with all Charges payable to such Lender or such Issuing BankLender, shall be limited to the Maximum Rate; provided, that such excess amount shall be paid to such Lender or such Issuing Bank on the subsequent payment dates to the extent not exceeding the legal limitation.
